Thuzi and Fish ("Thuzi/Fish" or "We" or “Our” or "Us") are concerned with your privacy and your understanding of how your personal information may be collected, viewed, analyzed and used in conjunction with any of Our websites including, and, hosted applications or Thuzi/Fish mobile applications (collectively the "Services"). This Privacy Policy only applies to Thuzi/Fish and our Services. Thuzi/Fish also acts as a data processor for our clients (the “Clients”) who use our Services as well.  When you provide information through our Services while we are acting as a data processor for a Client, you are effectively providing the information to that Client directly and it is only processed and temporarily held by Thuzi/Fish for delivery to the Client. The intent of this policy is to document how your personal information may be gathered and used by Thuzi/Fish. By using our Services you consent to the collection of your personal information as outlined in this Privacy Policy. Please note that it is likely that you will use our Services on or through websites or applications that may not be controlled by Thuzi/Fish. Thuzi/Fish encourages all of our users to review privacy policies on any site where you may be sharing your personal information. Our Services may attempt to collect information through a number of different methods. In many cases we collect information that you provide directly and voluntarily when interacting with our Services. When using our Services you may be offered the chance to submit your own personal information such as your name, email address, ZIP Code, gender, birth date, hobbies or other items of interest. This information is collected to enhance your experience by providing feedback, responses or content that is generated by you while engaging with the Services.  If the information may possibly be used for any future contact, you will be presented with an opt-in to accept or deny the use of your contact information for future use.

In addition to the information about yourself, you may also be providing information during the usage of the Services such as voluntary participation in surveys, contests, photos, videos or other submissions. Our services may also collect aggregate information about our users.

You should also be aware that it is standard practice to collect web-based browser information that helps us to improve our Services. Examples of browser-based information may include information such as referring sites, website visit statistics, entry pages, exit pages and your IP address and other information available in this manner. We may also collect information regarding the usage of our Services.

Thuzi/Fish attempts to protect personal information that it collects, but these measures are not failsafe. In general we attempt to prevent the misuse of any information we collect through industry standard safeguards such as encryption, firewalls and highly secure data hosting facilities.


Thuzi employs a unique technology in its Thuzi Event Pass® platform that interacts with special sound tones. This technology requires permission to access the microphone on a smartphone and it will not work if the permission is not granted. When in use, the Thuzi Event Pass Mobile App may "listen" only for specific sound codes, and no audio of any kind is recorded. There is no listening for voice or other ambient noises, only ultra high frequency tones that trigger functionality on the Thuzi Event Pass Mobile App.


Thuzi/Fish does not knowingly request or collect information from children under the age of 13. If you are under 13 we ask that you not use our Services, or if you are providing the care of a child under the age of 13 we ask that you prevent them from using our Services. If we learn that we have inadvertently collected information from a child under the age of 13, we will delete that information as quickly as possible. If you feel that we might have information from or about a child under 13, please contact us at For children ages 13 to 18, we strongly recommend gaining parental approval prior to sending any personal information or using our Services.


"Cookies," are a commonly used concept on the Internet designed to store user information such as their preferences when visiting a website. We may use Cookies to improve our Services and make your web experience more personal or more convenient, but they may also be used to collect usage statistics. Web browsers contain settings allowing you to control the use of cookies and whether you want to accept them. In some cases, eliminating cookie access may make it impossible to access certain functions of our Services. It is also possible that we, or a third-party advertising company may also use or provide a pixel tag, clear gif, or beacon to help manage and optimize our ability to measure the usage of our Services and to provide better online advertising. We may use the personal information we collect to provide entertainment or value-added services to you. Thuzi/Fish does not provide personally identifiable information to third party advertisers but may provide categorical information in order to post third party advertisements. The personal information may also be used to further personal communication through the sending of messages to you. Such messages or direct communication may be used to respond to comments, deliver notifications, or to send promotional information. You may always opt-out of those deliveries by following the opt-out instructions on the received communication.

Thuzi/Fish may disclose information about you to its Clients as part of our Services, in order for that Client to communicate with you and to provide you with advertising and promotional information. You should be able to opt-out of those deliveries by following the opt-out instructions on the communication you receive from them. We provide the information to these Clients including your opt-in selections that you have provided via the Services but we cannot control how that information is used by the Client.

Thuzi/Fish may also access, preserve and disclose any information we have about our users if required to do so by law, or in a good faith belief that such access or disclosure is reasonable necessary to avoid liability, to comply with legal process or to protect our rights and property or that of our partners or the general public. Thuzi/Fish is not required to contest the validity of any search warrant, subpoena or other similar governmental request.


We reserve the right to transfer your personal information in the event of a transfer of ownership of Thuzi via an acquisition, company merger or otherwise.

Your Ability to Edit and Delete Your Account Information and Preferences

When acting as a data processor for our Clients, Thuzi/Fish strongly recommends that our Clients provide information and opt-out instructions for their visitors or those it communicates with electronically. Our Services often contain links to other websites. We are not responsible for the privacy practices of these sites or of our Clients. If your data has been provided to one of our Clients, you will need to contact them directly for any changes to the access or use of your information.

While your data is managed by Thuzi/Fish, we provide all users options to change how this data may be accessed.  These options are in line with the European data privacy law known as the EU General Data Protection Regulation, or more commonly referred to as the “GDPR”. The additional options include the following:

  • Access and Export: You may request a machine-readable format export of your data by contacting
  • Limit Use: You can request that we limit the use of your data by contacting
  • Rectification: If you find inaccuracies in your information, you have the ability to request that those inaccuracies be corrected by submitting a detailed request to
  • Removal: You can request that your data be removed from the Services by contacting

All inquiries will receive responses within 30 days of our receipt of them.

Thuzi/Fish cannot make changes to any data that is the property of our Clients that we are no longer providing the services of a data processor.  

For Residents of California - California Consumer Privacy Act (CCPA)

The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

You have the right to request that Thuzi/Fish disclose certain information to you about our collection and use of your personal information over the past 12 months. You can make this request by emailing (see section above Your Ability to Edit and Delete Your Account Information and Preferences). Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

•          Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.

• Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. We only use personal Information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

Once we receive and confirm your verifiable consumer request, we will disclose to you:

• The categories of sources for the personal information we collected about you.

• Our business or commercial purpose for collecting or selling that personal information.

• The categories of third parties with whom we share that personal information.

• The specific pieces of personal information we collected about you (also called a data portability request).

• If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:

• sales, identifying the personal information categories that each category of recipient purchased; and

• disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.

Your information may be shared with a third party for the following business purposes:

Security - Detecting security breaches, Protecting against fraud and malicious activity, Taking action against wrongdoers (e.g. fraudsters and hackers)

Debugging - Identifying and fixing technical errors

Short-term uses - Contextual ad customization that does not involve or contribute to profiling

Performing services - Account maintenance, Customer service, Processing transactions, Marketing

Internal research to develop or demonstrate technology

Testing or improvement of any service or device “owned, manufactured, manufactured for, or controlled by” the business.

• Suggest that you may receive a different price rate for goods or services or a different level of quality of goods or services.


We may update this Privacy Policy and its updated date to reflect changes to our data governance practices. If we propose to make any material changes, we will notify you by means of a notice on this page prior to the change becoming effective.
